Terms and Conditions
1. Scope and Provider
These Terms and Conditions apply to all orders placed by consumers via the online store:
EazyBot.de
Owner: Frank Masur
c/o SourceArt
Fritz-Thiele-Strasse 3
28279 Bremen
Germany
(referred to hereafter as "we" or "EazyBot Merch").
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB – German Civil Code).
2. Conclusion of Contract
The presentation of products in our online store is not a legally binding offer, but rather a non-binding online catalog.
By submitting your order, you are making a binding offer to conclude a purchase contract. Receipt of your order is confirmed immediately after submission by an automated email. This confirmation does not constitute acceptance of the offer.
A binding contract is formed only when we explicitly accept your order via a separate confirmation email or by shipping the goods within five (5) business days.
3. Customized Products / Made-to-Order Production
All products offered in this shop are made individually for you — especially through printing or embroidery with the “EazyBot” logo or other brand-specific features.
According to § 312g para. 2 no. 1 BGB, withdrawal, revocation, or return is excluded for custom-made goods unless the item is defective according to statutory warranty provisions.
4. Prices and Shipping Costs
All prices are in euros and include statutory VAT. Shipping costs are listed separately at checkout.
For deliveries outside the EU, additional duties, taxes, or fees may apply, which are the responsibility of the customer.
5. Delivery and Shipping
Delivery is made directly from our production partner to the address provided by the customer.
Production and shipping times vary depending on the supplier, product, and destination region, and are indicated on the respective product pages. Average delivery times range between 14–21 business days.
We are not liable for delays caused by force majeure, supply shortages from third parties, or other unforeseen events.
6. Payment
Payment is made using the methods available at checkout, such as credit card, Klarna, instant bank transfer, or PayPal. Your account will be charged immediately upon completion of the order.
7. Right of Withdrawal and Exclusion
No right of withdrawal for customized products
According to § 312g para. 2 no. 1 BGB, there is no right of withdrawal for goods made to customer specifications or clearly tailored to personal needs.
As all products in this shop are made individually for you (e.g., by printing the EazyBot logo), withdrawal is excluded.
8. Voluntary Return / Restocking Fee
In rare individual cases, returns may be accepted on a goodwill basis after prior agreement. In such cases, we reserve the right to charge a restocking fee of 20 % of the product value. Return shipping costs are the responsibility of the customer. Promotional items are excluded from return.
9. Retention of Title
Goods remain our property until full payment has been received.
10. Warranty and Defects
The statutory warranty rights apply.
If the delivered item is defective or damaged, please contact us within 7 days of receipt via email, ideally including a photo of the defect. We will arrange for a replacement or refund in accordance with legal regulations.
11. Liability
We are liable without limitation for intent and gross negligence, as well as for injury to life, limb, or health.
In the event of minor negligence, we are only liable for breaches of essential contractual obligations (cardinal duties), and such liability is limited to typical, foreseeable damages.
12. Data Protection
For information about how we process personal data, please refer to our [Privacy Policy].
13. Dispute Resolution / Online Dispute Resolution
The European Commission provides a platform for online dispute resolution:
https://ec.europa.eu/consumers/odr/
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final Provisions
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
